Terms & Conditions

These terms and conditions constitute an agreement between Nigel Lord Photography (Photographer) and the commissioning Client and may only be modified in writing.

 

1. General Terms

Upon mutual agreement and confirmation of an assignment, the Client agrees to pay a non-refundable retainer of 50% of the total estimated production and creative fee (including agreed travel expenses) within 48 hours of assignment confirmation and prior to the commencement of the shoot. This retainer secures the booking and reserves the Photographer’s time exclusively for the Client.

The remaining balance will be invoiced upon completion of the assignment and is payable within 7 days of delivery of the final approved images. Payment of the retainer constitutes acceptance of these Terms and Conditions.

2. Cancellations

If the Client cancels within 48 hours of the confirmed shoot date, 100% of the creative fee will be charged, together with 100% of agreed expenses. This reflects loss of opportunity due to the exclusive booking of the Photographer’s time.

 

3. Client Representation on Shoot

If the Client or their representative is not present during the shoot to approve test images, the Photographer’s professional interpretation will be deemed fully approved.

 

4. Weather Delays / Postponements

Weather delay or reshoot days are charged at USD $500 per day for the Photographer and USD $150 per day per assistant, plus all agreed on-site expenses. Where accommodation is provided by the Client, assistant fees remain payable.

 

5. Image Delivery

Low-resolution preview images are typically delivered within 72 hours. Requests for revisions must be made within 7 days of delivery. After this period, additional editing time will be charged at the Photographer’s standard hourly rate. High-resolution images are released upon request after full payment.

 

A re-ordering fee of USD $80 applies for any image retrieval or re-supply more than 14 days after final delivery.

6. Standard Image Licence

Upon full payment, the Photographer grants a non-exclusive, non-transferable licence to use the delivered images strictly for the agreed purpose stated on the invoice.

Images may be used for the Client’s direct self-promotion only, including:

- Official website of the property or business

- Social media accounts owned and operated by the Client

- Direct marketing and listing platforms where the Client is the principal operator

 

Images may not be used for agency branding, portfolio promotion, or self-marketing by third parties.

Editorial use rights are not included unless expressly agreed in writing.

Commercial usage beyond standard promotional use requires a separate licence.

 

7. Permitted Adjustments

The Client may make only minor, non-destructive global adjustments, limited to:

- Exposure and brightness correction

- White balance adjustment

- Minor contrast adjustment

- Cropping and resizing

All adjustments must not materially alter the composition, intent, or realism of the image.

 

8. Prohibited Alterations

The Client may not, without prior written consent:

- Add, remove, or replace any elements within the image

- Alter skies, weather conditions, or environmental features

- Create composites or derivative works

- Use AI tools to modify, enhance, or reinterpret images

- Apply heavy stylistic or interpretive editing

 

Any unauthorised alteration constitutes a breach of license.

9. Derivative Works

Any modification beyond permitted adjustments is considered a derivative work and requires separate written agreement and additional licensing fees.

Unauthorised derivative use will result in immediate termination of the image license.

 

10. Intellectual Property and Moral Rights

The Photographer retains full copyright and moral rights in all images, including the right to object to any distortion, modification, or treatment that may be prejudicial to the Photographer’s reputation or authorship.

 

11. Third-Party Use (Rental Agencies / Booking Platforms)

The Client (property owner) may permit appointed rental agencies or booking platforms to use the images solely for the purpose of marketing and promoting bookings for the specific property identified in the invoice or assignment.

Such use is strictly limited to the promotion of that property only and does not grant any rights for the agency or third party to use the images for:

- Promotion of the agency’s own brand or services 

- Portfolio use or self-promotion 

- Advertising unrelated properties 

- Social media content promoting the agency 

- Marketing campaigns where the agency is the primary brand being promoted 

Images may not be sublicensed, transferred, or reused for any other property or purpose.

All rights remain non-transferable and subject to the Photographer’s copyright.

Any use outside the scope of “property booking promotion for the specified villa only” requires prior written consent and may incur additional licensing fees.

12. Licence Restrictions

The licence granted is strictly limited to the images delivered and listed on the final invoice. No rights are transferred beyond those expressly stated.

 

 

This agreement applies to all assignments unless otherwise agreed in writing
